5. Mayor’s Report

Landlord/Tenant Ordinance

Being considered on first reading this evening is the revised

Landlord/Tenant ordinance which enhances the ability of the township to

regulate the rental community. Last year, under the guidance of

Committee Member Elaine Taylor, the Township Committee moved

forward with an initiative to improve the township’s oversight of rental

properties. While this committee collectively agreed with the concept of

increasing control over the rental community, the original ordinance

proposed provisions that were contrary to federal housing law, namely,

denying housing to individuals who happen to have a past criminal record.

Barnegat Township CANNOT require landlords to deny housing to

potential tenants who have a criminal record. That is discrimination and

against the law. Additionally, requiring landlords to perform a criminal

background check adds no value to the process, as again a criminal past

cannot be a basis for denying housing.

As a result of the ordinance being contrary to federal law, it was not

adopted on second reading. Realizing the need to enhance the ability of

the township to regulate rental properties, I took the opportunity to meet

with the Township Administrator and Township Attorney to discuss how

existing township laws could be modified to accommodate expanded

oversight of the rental community. With the input of the administrator and

the attorney along with observations and recommendations from the

Police Chief and Construction Official, a straight forward, yet effective

change was made to existing town law that required landlords to evict

tenants after a second conviction of a drug related offense. The burden of

eviction is placed squarely on the landlord with substantial fines imposed if

the landlord fails to act. Again, while federal law prohibits denying housing

based on past criminal history, it does allow eviction of a tenant based

violation of the lease agreement or valid township ordinance.

Furthermore, at the recommendation of the Construction Official, the

township has increased the scope of the rental inspection required under

current Township law. Between increased scrutiny of tenant’s conduct and

actions along with expanded rental property inspections, I am confident

that this revised ordinance will achieve the desired goal of improving the

living conditions of rental properties in Barnegat along with having a

positive impact on Barnegat’s quality of life.

Edwards School – Downtown

Constructed in 1930, the Elizabeth Edwards School has been the

cornerstone of historic downtown Barnegat for over 80 years. Known

originally as Barnegat High School, the building has served the Township

well, but with the construction of new educational facilities, the Edwards

School has not been home to students for well over 10 years. Instead, the

building has been used to house some administrative offices along with

providing a space for the district’s bus drivers. Simply put, the structure

has been under utilized for a number of years. Recently, the school district

made a decision to decommission the building and turned off utilities and

boarded up the windows.

Economic development of Barnegat is a priority for this committee. We all

would like to see a larger commercial footprint in town, including the

historic downtown area. Key to the future revitalization of the downtown is

the productive use of the Edwards School. In its current state, it

represents a disincentive to any potential investors in Barnegat. Having a

public building with wood over the windows on highly traveled route 9

sends a wrong message about Barnegat, and we as a community need to

fix that … And we need to fix it fast.

In response, Deputy Mayor Marty Lisella and I will be reaching out to the

Board of Education in hopes of establishing a meaningful working

committee dedicated to realizing a productive and beneficial purpose for

the Edwards School. While many uses for the building have been

discussed, a consensus on the eventual use of the structure must be

reached so that we can move forward on a definite plan of action. This has

far reaching implications for the future economic viability of the downtown

so it is crucial as a community we work together to resolve this concern. I

look forward to meeting with the School Board to start discussions on the

possible future uses of the Edwards School.

6. Committee Reports

Deputy Mayor M. Lisella

Economic Development

Attracting additional commercial development along with beneficial

residential projects to Barnegat is critical to the future economic success

of this community. Since January 1, Mayor Susan McCabe and I had an

opportunity to meet with developers interested with investing in Barnegat.

While plans need to be finalized, I am excited to announce this evening

the following projects:

1. Shoreline Sand and Gravel Pit

A developer with a proven track record of success acquired the large

property in a bankruptcy sale last year. Conceptual plans for the property

are for an upscale rental development with many amenities, including a

club house, to be constructed on the site. This rental development would

be age restricted. While many details need to be resolved, I am

encouraged with the commitment of this developer to produce a quality

senior residential development for Barnegat.

B. Barnegat Crossings – Lighthouse Drive

The developer for this large commercial property on Lighthouse Drive has

stated that construction of phase 1 of the project will commence late

spring, early summer. In order to secure necessary financing for the

project, the developer will approach the work in phases. In addition, to

achieve financial feasibility required by banks or lenders, the developer

will incorporate age restricted apartments above the commercial

establishments. The apartments will have dedicated underground parking

separate from the commercial parking. This village concept of

development is consistent with the township’s master plan and while this

change will require Planning Board approval, it reflects a compromise

required for commencement of this much needed commercial project in

Barnegat.

Barnegat Police Department

Congratulations are in order for the Barnegat Police Department as

recently Barnegat has been recognized as one of the safest communities

in New Jersey. Safewise, a home security website, has identified Barnegat

as one of the 50 safest towns in New Jersey with a population over

15,000. Ranking 38 on the list Safewise used data from the FBI Crime in

the United States report along with their own comprehensive investigation

of New Jersey communities to determine the rankings.

Barnegat Police do an outstanding job and as elected officials, we have

both a legal and moral obligation to provide needed resources so that

Barnegat Police can continue doing impressive work in protecting

residents of this community.

A. Bille

Snow Plowing

First off, I would like to publicly acknowledge the efforts of Public Works

and Water/Sewer personnel with keeping the roads safe during this brutal

winter. The snow operation in Barnegat is exceptional and is a direct result

of the dedicated work of all involved. Regardless of any winter storm

approaching Barnegat, I feel safe knowing that we have capable, talented

and hard working township employees that will respond to the storm and

keep our town safe.

Snow operations are a team effort among all Township departments and

offices and indeed we have an all star team managing our snow

operations. Great job by all and please keep up the outstanding work.

Landlord/Tenant Ordinance

Regarding the Landlord/Tenant ordinance on the agenda for first reading

tonight, I am in full agreement with the remarks made by Mayor McCabe.

It is important to have an ordinance in place that is effective in regulating

the rental community in Barnegat and it appears the Mayor has been

successful with accomplishing that goal.

Furthermore, this ordinance represents the first step with addressing the

ongoing quality of life issues occurring in certain neighborhoods of

Barnegat. Working with the Mayor, members of this committee and the

administrator, I would like to develop a comprehensive approach or plan

with resolving the social-economic problems that have plagued several

areas of this community for way too long. As governing body members,

we represent the entire community and I firmly believe the investment

made with addressing these concerns will not only improve the quality of

life for many hard working and deserving residents of Barnegat, but will

have a positive impact on the overall value of property in the township.

Frankly, I grow weary of hearing Barnegat being referred to as “Barn-aghetto”

and we must take decisive action now to resolve the urban like

social, economic and crime related issues existing in certain areas of

Barnegat. I am committed to the well being of the whole town and will

work diligently in making sure all residents have the ability to live in peace

and safety while residing in Barnegat.

L. Morano

Barnegat Public Works has done an outstanding job clearing our roads of

snow and ice this winter. An update on the Sweet Jenny’s Route 9

project: March will be their final approval, with a supermarket, Denny’s

Restaurant, Dunkin’ Donuts, and more businesses signing up every day,

which will bring in ratables. May I ask why we are purchasing

motorcycles? Admin: they will aid the Police Dept. to access areas that

the bicycle patrol can not. Ocean County security does not have the

jurisdiction or the authority of a police officer. Questions on the audit will

be answered when it is on the agenda, scheduled for March.

E. Taylor: Thank you to the Mirage Women’s Club, they raised $11,000 for

the “Go Red” foundation, bringing heart disease awareness to women.

Thank you also goes to Sharon Auer and Maryellen Brown, for getting our

TV channel up and running. They worked very hard to make my promise

to the residents of Barnegat a reality. We will be broadcasting our first

meeting in April. My question to mayor McCabe: You stated previously

that we would not spend more than $20,000 on the Lower Shore Road

field. To date we have spent over $60,000. SM: there was an expansion

in the scope of work requested by the Township, in order to have a first

class facility capable of handling the crowds associated with the games,

causing an increase in charges. We have utilized volunteers saving the

Township thousands of dollars. ET: The residents should have been

made aware of the increase in funds.

I reference to the tenant ordinance on tonight’s agenda; bad landlords

and problem tenants, we need a strong effective ordinance. The

ordinance I proposed called for landlords to register tenants and a

property rental license. Unfortunately this ordinance was tabled with

promise of a new, better ordinance this year. Unfortunately the

improvements I have heard about do not make the ordinance any better,

they weaken it and make it less effective. In 2013 I introduced an

ordinance that, and requires a rental license for each property. The cost

of registration would be covered by $125.00 fee paid for by the landlord.

I make a motion to re-introduce the original ordinance tabled in

December 2013:

7. Administrator’s Report

Update on treatment of roads by Public Works to keep roads clear of snow

and ice, a costly endeavor to maintain township roads during the winter

season. The township engineer Dave Cella and firm of ARH were given

an award based on the design, plan and construction management of our

municipal dock. Reviewed ordinances and resolutions on this agenda.

Jim Rostron – (Barnegat Landlord): The garbage in the Lexington area is

ridiculous, the tenants should be required to bag garbage, it is blowing

around the area. In regard to Elaine Taylor’s proposal of the ordinance,

how am I supposed to know if my tenant commits a crime? ET: If there

were two or more conviction, you would be notified, this could be a basis

to begin eviction procedures.

Frank Pecci – 11 Hemlock Drive: For years I have asked the school board

to do something with that building, it is an ideal location. We have ATV’s

and bicycles to use versus the motorcycles. Emergency management:

there is a line item on the budget for salary & wages for police at

$230,000. What were the negotiations or percentage for the Water &

Sewer bargaining unit?

Hillary Azari (sp?) 24 Hannah Lee Road: we have had a problem with the

easement between 24 & 26 always being mushy with water all year round.

This has gone on for several years, how do I get the storm drain checked?

Engineer: I have a punch list stating this inlet is on the list.

Chuck Daley – 1 Lilac Lane: what interest are we trying to accomplish with

this tenant/landlord ordinance? Atty: the thought behind the ordinance is

to impose an obligation on the landlord to police their tenants, and take

more responsibility for the tenants and properties. ET: I think having a

strong ordinance it would put a dent in the 96 drug arrests in town. As a

landlord what am I to do? Do you think I will be able to have the tenant

evicted base on drug convictions? Atty: we are addressing the habitual

drug offenders, to improve Barnegat. What about my lease, and lawyer

fees to evict? The fines are on the landlord, not the offending tenant.

Admin: this ordinance provides a mechanism to allow the Township to

address the habitual chronic drug users, in addition to expanding the

scope of the C.O. inspection in order to enhance the Township to force

landlords to maintain their property in an acceptable condition; it is a first

step in the process.

Walt Fernandez – 31 Fifth Street: I applaud the motion for the

motorcycles; it has been needed in this town for a while, such as traffic

events. I was involved in an accident of Route 72, both the police and

quality ambulance service were excellent. There are many code violations

in other parts of the town, my street, Fifth Street, is a big problem areas.

We need to enforce violations in all areas of the town.

Angela Koutsouris – 15 Jon Drive: I see tremendous value in the

purchase of the motorcycles, enabling the enforcement of violations. I had

vandalism on my property, and the motorcycle could have aided in

patrolling that area. I support the new ordinance regarding renters, I am a

landlord in another town, and have similar clause in my lease with tenants.

Denise Pilovsky – 26 Aphrodite Drive: Was the first introduction of the

landlord ordinance legal? Attorney: Yes. Township appointed an RFP to

not the lowest bidder. Admin: after review of the RFP’s the Township

Committee felt comfortable with this firm, based on merit.

Jake Taylor – 106 Newark Road: The Public Works has the snowplowing

down pat. We do not need two motorcycles for the Police Department.

We were told the Lower Shore Field would only cost us $20,000.

Morris Flory – 4 Blue Claw Drive: will there be an archive for viewing

videos on the cable channel? Admin: we will consider our options.

Daniel Day – 200 Edison Road: How much have we received from FEMA

for the dock? Admin: we have received a few hundred thousand dollars

so far. We have sent bills for $1.2 million.

Arthur Robidoux – 108 Ravenwood Blvd.: what are the plans for the

development of the Shoreline property? ML: it is still in the preliminary

stages. Would recreational facilities be proposed for the area? The

Lower Shore Fields; when it is done will it be certified as useable and

serviceable by someone? And what is the responsibility of the Township?

Admin: The Ocean County Joint Insurance Fund will inspect it when it is

finished.
